<br />WHEREAS, pursuant to the provisions of Chapter 170, Florida Statutes, and <br />Resolution Nos. 2007-1115 and 2007-1116, Resolution No. 2007-1115 has been published, and <br />notice of the proposed assessments and the equalization public hearing has been provided by <br />mail and by publication; and <br /> <br />WHEREAS, at a public hearing on July 24, 2007, and the Commission heard <br />and considered comments and objections of all interested persons; and <br /> <br />WHEREAS, the City Commission has determined that imposition of special <br />assessments to fund a portion of the cost of providing sanitary sewer improvements and <br />associated road restoration to benefit and serve properties located on Atlantic Isle is reasonable <br />and appropriate and in the interest of the public health, safety and welfare; and <br /> <br />WHEREAS, the City Commission has determined that the assessments adopted <br />pursuant to this Resolution are based upon special benefit to each assessed property and that the <br />total assessment imposed on each parcel is reasonable, appropriate and does not exceed the <br />special benefit to be provided by the sanitary sewer improvements and associated road <br />restoration; and <br /> <br />NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF <br />THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Incorporation of Recitals. The recitals contained in the Preamble to this <br />Resolution are adopted by reference and incorporated as if fully set forth in this Section. <br /> <br />Section 2. Description of Improvements on Atlantic Isle. The City Commission <br />(the "Commission") of the City of Sunny Isles Beach, Florida (the "City") has determined <br />that construction of certain capital improvements benefiting property on Atlantic Isle (also <br />known as Atlantic Island) is advisable and in the public interest. The improvements <br />contemplated by the City include sanitary sewer and associated pavement restoration of <br />Atlantic Avenue, water main improvements, drainage improvements, and under grounding <br />of existing utilities. The total estimated cost of these public improvements is over <br />$4,000,000, with $2,018,823.40 of that total estimated for construction of the sanitary sewer <br />improvements and associated pavement restoration. All of these improvements provide <br />substantial and special benefit to properties on Atlantic Isle, but the City is levying non-ad <br />valorem special assessments to fund only $1,009,000, not including interest, of the sanitary <br />sewer improvements and associated road restoration costs. The remaining costs of the <br />public improvements will be funded by the City from other lawfully available revenue or by <br />other entities. <br /> <br />Section 3. Estimated Cost of Improvements to be Funded by Special Assessments. <br />The estimated cost of improvements to provide sanitary sewer service to property on <br />Atlantic Isle, including associated road restoration, is $2,018,823.40. Such improvements <br />include, but are not limited to, collection lines, force main, laterals, pump station, <br />associated road restoration and other associated improvements.
