WHEREAS, pursuant to the provisions of Chapter 170, Florida Statutes, and Resolution Nos. 2007-1115 and 2007-1116, Resolution No. 2007-1115 has been published, and notice of the proposed assessments and the equalization public hearing has been provided by mail and by publication; and WHEREAS, at a public hearing on July 24, 2007, and the Commission heard and considered comments and objections of all interested persons; and WHEREAS, the City Commission has determined that imposition of special assessments to fund a portion of the cost of providing sanitary sewer improvements and associated road restoration to benefit and serve properties located on Atlantic Isle is reasonable and appropriate and in the interest of the public health, safety and welfare; and WHEREAS, the City Commission has determined that the assessments adopted pursuant to this Resolution are based upon special benefit to each assessed property and that the total assessment imposed on each parcel is reasonable, appropriate and does not exceed the special benefit to be provided by the sanitary sewer improvements and associated road restoration; and NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The recitals contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Description of Improvements on Atlantic Isle. The City Commission (the "Commission") of the City of Sunny Isles Beach, Florida (the "City") has determined that construction of certain capital improvements benefiting property on Atlantic Isle (also known as Atlantic Island) is advisable and in the public interest. The improvements contemplated by the City include sanitary sewer and associated pavement restoration of Atlantic Avenue, water main improvements, drainage improvements, and under grounding of existing utilities. The total estimated cost of these public improvements is over $4,000,000, with $2,018,823.40 of that total estimated for construction of the sanitary sewer improvements and associated pavement restoration. All of these improvements provide substantial and special benefit to properties on Atlantic Isle, but the City is levying non-ad valorem special assessments to fund only $1,009,000, not including interest, of the sanitary sewer improvements and associated road restoration costs. The remaining costs of the public improvements will be funded by the City from other lawfully available revenue or by other entities. Section 3. Estimated Cost of Improvements to be Funded by Special Assessments. The estimated cost of improvements to provide sanitary sewer service to property on Atlantic Isle, including associated road restoration, is $2,018,823.40. Such improvements include, but are not limited to, collection lines, force main, laterals, pump station, associated road restoration and other associated improvements.
