<br />cost, $1,009,000, not including interest, is to be funded by special assessments imposed on <br />benefited property as shown in the Final Assessment Roll attached as Exhibit A. <br /> <br />Section 4. Benefited Area. The City hereby determines that the levy of non-ad <br />valorem special assessments is needed to fund a portion of the cost of providing necessary <br />sanitary sewer improvements that provide special benefit to property on Atlantic Isle. With <br />the adoption of this Final Assessment Resolution, the City hereby imposes a special <br />assessment on all lots and lands on Atlantic Isle specially benefited by the sanitary sewer <br />improvements through the provision of sewer lateral connections. The sanitary sewer <br />improvements will provide special benefit to all lots and lands on Atlantic Isle capable of <br />being served by the sanitary sewer improvements. Each lateral sewer connection that will <br />provide or is capable of providing sanitary sewer service to the assessed property is the <br />measure of benefit, or Benefit Unit, used to calculate the special assessments for each <br />benefited parcel. The method of calculating the special assessments is detailed in the <br />Atlantic Isle Special Assessment Methodology Report, dated July 16, 2007, which report <br />shall be available from the City Clerk. The special benefit provided by the sanitary sewer <br />improvements is hereby determined to be equivalent to the number of lateral sewer <br />connections constructed for each lot or parcel as shown in the Final Assessment Roll <br />attached as Exhibit A, as may have been adjusted by the Commission based on evidence <br />and testimony provided at the equalization hearing. <br /> <br />Section 5. Collection of Special Assessments. With adoption of this resolution, <br />the City imposes non-ad valorem special assessments on all benefited property on Atlantic <br />Isle for assessed costs of $1,009,000, not including interest, which is only a portion of the <br />cost of the sanitary sewer improvements. The assessed costs of $1,009,000, not including <br />interest, shall be collected through special assessments imposed by the City for the sanitary <br />sewer improvements. The special assessments shall be payable as shown in Exhibit B to <br />this Resolution, with the initial payment to be billed after completion of the planned <br />sanitary sewer improvements anticipated in late 2007 or in 2008. The assessment may be <br />billed annually by the City directly to each property owner or may be included on the <br />annual property tax bill pursuant to the Uniform Assessment Collection Act upon <br />fulfillment of additional requirements in Section 197.3632, Florida Statutes. Subsequent <br />installments of the special assessment shall be due annually. The special assessment, <br />including interest accrued to date, may be prepaid in full at any time after construction of <br />the improvements. Upon failure of a property owner to pay any annual installment due, or <br />any part thereof, or any annual interest upon deferred payments, the City shall cause to be <br />brought the necessary legal proceedings to enforce payment thereof, with interest and <br />penalties, together with all legal costs incurred, including reasonable attorney's fees, to be <br />assessed as part of the costs, and in the event of default in the payment of any installment of <br />an assessments, or any accrued interest on said assessment, the whole assessment, with the <br />interest and penalties thereon, shall immediately become due and payable and subject to <br />foreclosure. In the foreclosure of any special assessment service of process against <br />unknown or nonresident defendants may be had by publication, as now provided by law in <br />other chancery suits. The foreclosure proceedings shall be prosecuted to a sale and <br />conveyance of the property involved in said proceedings as now provided by law in suits to <br />foreclose mortgages; or, in the alternative, said proceedings may be instituted and <br /> <br />Page 3 of 14 <br />
