<br />IV. Standards of Review for Conditional Use <br /> <br />Pursuant to Section 265-13( c) of the City Code, the following factors should be considered <br />in granting a conditional use: <br /> <br />(1) The proposed use shall be consistent with the Comprehensive Plan: the request is <br />for a conditional use and sign variance and it is consistent with the Comprehensive <br />plan. <br />(2) The establishment, maintenance or operation of the proposed use shall not be <br />detrimental to or endanger the public health, safety, or general welfare: the <br />proposed conditional use is in conjunction with an existing use at the subject <br />property; <br />(3) The proposed use shall be consistent with the community character of the <br />immediate neighborhood of the proposed use: the proposed use is within the <br />character of the Neighborhood Business; <br />(4) Utilities, roadway capacity, drainage, and other necessary public facilities, <br />including police, fire and emergency services, shall exist at the City's adopted <br />levels of service, or will be available concurrent with demand as provided for in <br />the requirements of theses LDR's: the City of Sunny Isles Beach services met the <br />needs of the conditional use request; <br />(5) Adequate measures exist or shall be taken to provide ingress and egress to the <br />proposed use in a manner that minimizes traffic congestion in the public street: the <br />requested conditional use is in conjunction with an established use and does not <br />provide for an increase in traffic to the location; <br />(6) The establishment of the conditional use shall not impede the development of <br />surrounding properties for uses permitted in the zoning district: the proposed use is <br />in conjunction with an existing use and other properties that surround the subject <br />property have the same type of use; <br />(7) The design of the proposed use shall minimize adverse effects, including visual <br />impacts of the property use on adjacent property through the use of building <br />orientation, setbacks, buffers, landscaping and other design criteria: the proposed <br />use is within an established location. The location has taken measures to provide <br />landscape buffers and sufficient setback to preserve the possibility of any visual <br />impact. <br /> <br />V. Standards of Review for Sign Variance <br /> <br />Pursuant to Section 265-63.1 (c) of the City Code, the City Commission may grant a sign <br />variance if the City Commission finds: <br /> <br />(1) The variance is not contrary to the public interest; <br /> <br />(2) Special conditions and circumstances do not result from actions of the applicant; <br /> <br />(3) A literal enforcement of the provisions of this chapter may result in unnecessary <br />hardship. <br /> <br />NA V ARRO DISCOUNT PHARMACIES, LLC Z2011-01 CH <br /> <br />2 <br />
