The hours of operation of a liquor package store are established under section 98- <br />7(A). <br /> <br />The proposed liquor package store meets the 750 feet distance requirements of the Code <br />section 98-4 from an existing school or church, however, it fails to meet the spacing <br />requirement from another alcoholic beverage establishment as indicated previously. Staff has <br />reviewed the Application, and believes that the Applicant has satisfied the requirements for <br />conditional use. The store will not have a negative impact on its surrounding areas. The <br />conditional use approval granted to Epicure may be used as precedent, but it is important note <br />that Epicure is not the typical package store because it has a variety of other uses, which are a <br />restaurant and a grocery store. <br /> <br />The Applicant is also requesting a sign variance to allow an additional wall sign where only <br />two wall sign are permitted. The location of the proposed sign is on the wall of the <br />independent entrance/exit of the proposed liquor store and is conditioned on the approval of <br />the liquor package store. Staff has no objection to the proposed sign variance if the conditional <br />use application is granted. <br /> <br />IX. Conditions <br /> <br />(1) Upon the submittal of an application for building permit, the plans submitted shall meet <br />with the approval of the Planning and Zoning Administrator and be consistent with the <br />specific site plan approved by the City Commission. Plans shall include all the required <br />elements of the site plan pursuant to the City's Land Development Regulations and <br />recommendations. Should compliance with recommendations result in a change that <br />would not be considered "minor" in accordance with Section 265-18 of the City Code; the <br />Applicant shall be required to obtain another approval of the City Commission. <br /> <br />(2) That the project shall be developed substantially in accordance with the plans submitted for <br />public hearing. Plans are on file and may be examined in the Planning and Zoning <br />Department for Navarro Discount Pharmacies, LLC George E. Peon AlA AR # 0007999 <br />consisting of four sheets (A-l to A-4), dated January 28, 2011, and Liquor Survey for <br />18500 Collins A venue as prepared by James Beadman and Associates Inc. consisting one <br />sheet, all stamped received on March 11, 2011. <br /> <br />(3) That the Applicant comply with all conditions and permit requirements of the Department of <br />Environmental Resource and Management (DERM), the Miami-Dade County Fire <br />Department (MDFD), Water and Sewer Department, Department of Environmental <br />Protection (DEP), Florida Department of Transportation (FDOT). <br /> <br />(4) That the applicant obtains a Business License and a Certificate of Use from the City upon <br />compliance with all terms and conditions. The Business License and Certificate of Use <br />shall be subject to cancellation upon violation of any conditions. <br /> <br />(5) That the sale of distilled liquor will only be permitted during the store operation or as outline <br />under Chapter 98 of the City Code whichever is more restrictive. <br /> <br />(6) That the approval of this conditional use requires that the parking lot lights remain on from <br />dawn to dusk following the standard daylight and saving time guidelines. <br />NAVARRO DISCOUNT PHARMACIES, LLC Z20 11-0 1 CH 4 <br />
