<br />Summary Minutes: Regular City Commission Meeting <br /> <br />April 21, 2011 <br /> <br />City of Sunny Isles Beach, Florida <br /> <br />Florida, and because of their success we are to take a different measurement in granting a <br />variance, no, he doesn't see that as a measuring stick. There is no need to worry about <br />competition, traffic is less of a problem, however he agrees with Vice Mayor Thaler that <br />Navarro should look at the possibility of renting space in the lot that is available behind the <br />store in answer to some people's concerns that there may not be enough parking in the area. <br /> <br />City Attorney Ottinot clarified that the reason we are here tonight is the fact that Navarro is <br />less than 750 feet away from Publix, and that is the only issue at hand. If Navarro met the <br />distance requirement they could have filed the appropriate permit application with the <br />Building Department and opened the store as a matter of right. With respect to the shopping <br />center issue, over the years he and Acting City Manager Vera have worked with Richard <br />Steinig who had wanted to open a liquor store in the 170th St. Shopping Center. Because Mr. <br />Steinig could not pay the fees and he wanted to get a Conditional Use, we created an <br />exemption that would allow a liquor store in a shopping center if they have 221 parking <br />spaces and a gross area of 45,000 square feet. Navarro was not able to satisfy any exemption <br />under the City Code. The standards for Conditional Use are outlined in the Report and in the <br />Code, competition is not a factor, in terms of factors, and staff has reviewed the factors, and <br />these factors are listed in the report. <br /> <br />City Attorney Ottinot clarified a minor amendment that Navarro is to provide a surplus <br />parking plan within 30 days of approval of the application. <br /> <br />Vice Mayor Thaler moved and Commissioner Gatto seconded a motion for approval, subject <br />to staff conditions, as amended. Resolution No. 11-Z-121 was adopted by a roll call vote of <br />3-2 (Commissioner Aelion and Commissioner Scholl against) in favor. <br />Vote: Commissioner Aelion no <br />Commissioner Gatto yes <br />Commissioner Scholl no <br />Vice Mayor Thaler yes <br />Mayor Edelcup yes <br /> <br />[City Clerk's Note: The City Commission took a short recess, and then heard Item 100 <br />out of order.) <br /> <br />7.
