<br />Summary Minutes: Regular City Commission Meeting January 15,2004 <br /> <br />City of Sunny Isles Beach, Rorida <br /> <br />on the west side to tone down development and provide public plazas. Commissioner <br />Iglesias stated that the Transfer of Development Rights from privately owned sites to <br />sender sites, and based on the recommendation of the workshop that the City's Planner <br />said a 3.7 FAR could be obtained on certain sites by getting the enclosed parking, the <br />public bonus plaza, the public bay-walk, and site assembly, and in addition to that it was <br />his belief that there should be a lO-year date of windows when TDRs could be used for <br />private to private. Commissioner Iglesias stated that he has brought back a proposed <br />amendment that would give the City valuable land to be used for public purpose, mainly a <br />park, and he has toned down his lO-years to 5-years, toned down the FAR to 3.75, and <br />most importantly the fact that still remains at any time that the City doesn't like the <br />property that it is going to get, has a right to reject it. He noted that Vice Mayor Goodman <br />has been working two years trying to expand the Fire Rescue Station. <br /> <br />Mayor Ede1cup brought up two technical changes: when referred to owners ofTDRs this <br />is clarifying that to mean owners, their successors, heirs, or assigns; and, on page 11 there <br />is a second amendment that is basically asking the City to always act in good faith <br />whenever they are dealing on TDRs, because every time someone comes to the City to use <br />those TDRs, the Commission still has to approve those TDRs in a Site Plan Review, and <br />always has that discretion to accept or turn down the use of those TDRs by turning down <br />that site plan, and basically it is saying that a sender site donor shall be approved by the <br />City using good faith. Mayor Ede1cup further stated that this Ordinance is describing the <br />fact that there are two kinds of banks for TDRs, there is the bank for City-owned TDRs, <br />and there is the private bank that will exist in the situation where the sender does not use <br />all of the TDRs at an initial time on a new site, and therefore he will have a bank similar <br />to what the City has in which to use it over the 5-year period. City Attorney Dannheisser <br />stated that one last minor change is when we were talking about the balance of the 50,000 <br />square feet and the 100,000 square feet we were referring to City-owned not privately <br />owned. <br /> <br />Commissioner Iglesias moved and Commissioner Thaler seconded a motion to approve <br />the Alternative 2 proposal on first reading, as amended. The motion was approved <br />by a roll call vote of 5-0 in favor.
