<br />Summary Minutes: Regular City Commission Meeting January 15,2004 <br /> <br />City of Sunny Isles Beach, Rorida <br /> <br />SC. Sitting in as the Local Planning Agency and the City Commission, to Consider an <br />Ordinance Amending the Land Development Regulations (LDRs) <br /> <br />SC.1 Resolution of the Local Planning Agency of the City of Sunny Isles Beach, Florida, <br />Recommending to the City Commission of Sunny Isles Beach, the Ordinance Amending <br />Sections 265-34, 265-35, and 265-36 of the Zoning Code to Increase the Price of a <br />Bonus Participation Unit from $14,000 to $35,000 in Certain Zoning Districts, <br />Attached Hereto as Exhibit "A"; Providing for an Effective Date. <br /> <br />Action: City Clerk Hines read the title. <br />Public Speakers: none <br /> <br />Commissioner Brezin moved and Commissioner Iglesias seconded the motion. LP A <br />Resolution No. 2004-13 was adopted by a voice vote of 5-0 in favor. <br /> <br />SC.2 An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida, <br />Amending Sections 265-34, 265-35, and 265-36 of the Zoning Code to Increase the <br />Price of a Bonus Participation Unit from $14,000 to $35,000 in Certain Zoning <br />Districts; Providing for a Repealer; Providing for Severability; Providing for an Effective <br />Date. <br /> <br />(First Reading 12/18/03) <br /> <br />Action: City Clerk Hines read the title and Planning and Zoning Administrator Vera <br />reported. <br /> <br />Public Speakers: Clifford Schulman, Esq. <br /> <br />Mayor Edelcup explained what this Ordinance is. City Attorney Dannheisser said that it <br />bears a more rational nexus now to the actual cost of Capital Improvements. Vice Mayor <br />Goodman asked if the parking bonuses are within their own building or public parking, <br />and Mr. Vera said public parking. <br /> <br />Clifford Schulman, Esq., noted in Section 4 of the Ordinance, that it is unclear whether or <br />not projects that were previously approved with bonuses would partake of this increase. <br />He noted that in the TDR Ordinance that was just passed on first reading it says "this <br />amendment shall not apply to previously approved TDRs which transfer shall be <br />accomplished in accordance with the Ordinance", and he requested that similar language <br />be included in this Ordinance that it shall not apply to those projects for which bonuses <br />were previously approved, and the Commission had no problem with that. City Attorney <br />Dannheisser said that she will put under the effective date, that it shall be applied <br />prospecti vel y. <br /> <br />Commissioner Iglesias moved and Commissioner Thaler seconded a motion to adopt the <br /> <br />9 <br />
