Summary Minutes: Regular City Commission Meeting December 14,2006

City of Sunny Isles Beach, Florida

this Ordinance what you have the effect of happening is, when you have that setback there is
never anything that property can be but a gas station. He noted that at the last Commission
meeting the Commission said they would make specific rights for specific properties,
everyone would have the ability to come in and ask for that setback not to effect them, and
this is one of those properties that will be effected. He said it will effect the beautification of
the City specifically by having the gas station, it is an old building, and the property owner
cannot do anything to that building so it will always be there. He said he feels what should
happen is that every piece of property should be taken specifically on its own, that area is
commercial, and so what he is asking is that the accommodations for setbacks for certain
properties specifically this property with the setback there leaves no room for development
and so he just wanted to note their objection to the setback on this property.

Mayor EdeIcup stated as they said at the last meeting, we know that there are sometimes
small properties here in the City that have to be dealt with just like we dealt with them on the
east side of Collins Avenue. He said that generally resulted in somebody coming to the City
with a specific site plan and that specific site plan could be asking for variances which the
Commission would consider and either deny or grant based on what is being presented to
them. He said he thinks that that is the best way that they can handle this since there isn't a
specific site plan before us at this moment for that piece of property.

Vice Mayor Thaler moved and Commissioner Iglesias seconded a motion to approve the
resolution.
