<br />Summary Minutes: Regular City Commission Meeting December 14,2006 <br /> <br />City of Sunny Isles Beach, Florida <br /> <br />9E. Sitting in as the Local Planning Agency and the City Commission, to Consider an <br />Ordinance Amending the Land Development Regulations (LDRs) <br /> <br />9E.l A Resolution of the Local Planning Agency of the City of Sunny Isles Beach, Florida, <br />Recommending to the City Commission of Sunny Isles Beach, the Ordinance Amending <br />Section 265-34 of the Land Development Regulations Relating to "Medium-High Density <br />Multifamily Residential Zoning District (RMF -2)", Establishing Setback Requirements, <br />Attached as Exhibit "A"; Providing for an Effective Date. <br /> <br />Action: Mayor Edelcup reported that items 9E, 9F, and 9G are all very similar and each have <br />two parts, one where they are acting as the Local Planning Agency and one acting as the City <br />Commission, even though we are required to take six different votes on this maybe we can <br />cover it as one topic and then vote the six times, City Attorney Ottinot said that is fine <br />however it is a public hearing and we have to open each of them. Mayor Edelcup said he <br />would like to take them collectively and City Attorney said that was fine. City Clerk Hines <br />read the title. Mayor EdeIcup said all of these are basically the same, this item is 9E relating <br />to the Multifamily Residential Zoning District, RMF-2, Item 9F relates to the Neighborhood <br />Business District B-1, and Item 9G relates to the Town Center Zoning, so all three (3) of <br />these are identical in nature except that we are taking each Zoning District independently <br />even though we can discuss them all in total. <br /> <br />Assistant City Manager Vera reported that a couple of months back we had a workshop <br />regarding the look that we would like to achieve along Collins A venue. He said the <br />Commission took a hard look at this and they decided that they would like to have the open- <br />air effect instead of a canyon effect, which the current B-1 would have created and so the <br />Town Center zoning was recreated with the step-back, the building sets back as we get <br />farther into the properties. He said they took a look at all the parcels abutting Collins <br />A venue and took the depth of them, and depending on the depth, we assumed different <br />scenarios and within those scenarios, just to be sure that all the property owners reserved <br />their rights to build what originally was permitted there. He said right now as it stands, the <br />property owners could build what is permitted there from what was there before, the previous <br />zonmg. <br /> <br />Public Speakers: Sagi Shaked, Esq. <br /> <br />Commissioner Goodman asked if he meant grand fathering in for the people who own <br />property and we are changing it now. Assistant City Manager Vera said no, when we are <br />doing these modifications to the ordinance, we need to assure the property owners that we do <br />not take away any rights from them and we do not leave them with an non-buildable site. He <br />said right now all the property owners, after taking a look at it and with the modification <br />we've made, can still build a building within the parameters that they had previously, just a <br />little bit different, a little more setback, a little different design but they can still build it. <br />Mayor EdeIcup said basically it is assuring that the same volume can be built on the property, <br />and Assistant City Manager Vera said the height, the FAR, everything remains the same, it is <br />just the design, just like we saw earlier today [6A]. <br /> <br />Sagi Shaked, Esq. said he is here on behalf of Texaco on 183 rd Street and Collins A venue. <br />He said what they have issue with is the 50-foot setback and for this specific property with <br />9 <br />
