<br />Summary Minutes: Regular City Commission Meeting <br /> <br />May 15,2008 <br /> <br />City of Sunny Isles Beach, Florida <br /> <br />Action: [City Clerk's Note: Correspondence from RK Associates was distributed prior to <br />the meeting.) Mayor Ede1cup gave opening remarks on zoning procedures/decorum and City <br />Clerk Hines read a disclaimer for the Zoning hearing, and administered the oath to the <br />witnesses for the Zoning hearing. Community Development Director Robert Solera reported, <br />noting that the Applicant has also indicated that they want the Zoning fees of$5,000 waived. <br /> <br />Public Speakers: Arnold Shevlin; Raanan Katz; <br /> <br />Mayor Edelcup said the staff report should have reflected the two (2) colors already approved, <br />and City Attorney Ottinot said yes, as part of the settlement, and Vice Mayor Thaler said they <br />also have the ability to use their trademark colors. Community Development Director Solera <br />said there is exception to the rule: locations which hold a trademark can use the colors <br />associated with the trademark. Commissioner Scholl said if we have a carve-out for a national <br />business that is trademarked, we should allow the small businesses their sign criteria as well. <br /> <br />Arnold Shevlin, representing the applicant, requested three more colors be added to the two <br />colors they currently have for more flexibility, and that they also be permitted to have one <br />color in the front, with a different background color on a sign. He also asked to have two <br />different colors in the neighboring sign, which are uniform but gives it more color. The <br />approved sign code is a reversed channel letter, and he asked that they also be permitted to use <br />a straight channel letter, but with the same type of lettering and look. <br /> <br />Vice Mayor Thaler said that five colors plus the logo colors are too many in one shopping <br />center and he asked that Mr. Katz designate one or two sets of colors for each shopping <br />center. Mayor Edelcup said as long as a sign has no more than two colors, and he doesn't feel <br />you have to mandate those same two colors for every store in that particular shopping center, <br />but the fayade of the building should have all the same beige tone to it. He believes that two <br />colors on anyone sign with the exception of trademarks which we have always allowed in the <br />ordinance, is an appropriate sign. He disagrees with the idea of non-reverse straight channel, <br />as they should all be the same, and so he doesn't have objections to anyone sign having two <br />colors in any two neighboring stores. Commissioner Brezin and Commissioner Scholl agreed, <br />and Commissioner Goodman disagreed with having five colors. <br /> <br />City Attorney Ottinot clarified that the Applicant already has two approved colors, and is now <br />asking for three additional colors and to allow two-colored signs, however the reverse channel <br />remains, and the Commission agreed. He asked if it was prospective or retroactive in terms of <br />new signs, and Mayor Edelcup said it is prospective starting today. Community Development <br />Director Solera said that they provided to us specific colors with specific numbers, and he <br />wants to make sure those are the colors they use on the signs. Mayor Edelcup said there is <br />only one shade of each color allowed which we designated with Sherman Williams numbers. <br /> <br />Commissioner Brezin moved and Commissioner Scholl seconded a motion for approval, <br />subject to staff conditions, and to the additional conditions as outlined.
