<br />Summary Minutes: Regular City Commission Meeting November 17, 20 II <br /> <br />Sunny Isles Beach, Florida <br /> <br />for Receiving Sites; Providing for Zoning in Progress; Providing for Repealer; Providing for <br />Severability; Providing for Inclusion in the Code; Providing for an Effective Date and <br />Applicability. <br /> <br />(First Reading 10/20/11) <br /> <br />Action: [City Clerk's Note: This item was heard before Item 6A.] City Clerk Hines read the <br />title, and City Attorney Ottinot reported noting that the City Commission is also sitting in as <br />the Land Planning Agency and we combined the two matters for voting purposes. He <br />summarized the proposed Zoning Code provisions: in the Town Center District which is the <br />south side of Sunny Isles Boulevard, the proposed Ordinance will change the maximum <br />height for a phased project to increase it to 200 feet providing that overall height of all the <br />buildings on that project does not exceed 200 feet. That proposed change will not increase <br />density in that area. With respect to the MUR District which is on the east side of Collins <br />Avenue, the proposed Ordinance will increase the FAR from 4.0 to 4.6, which does not <br />increase density in that area. There are some additional changes in the MUR District, the <br />proposed Ordinance will also provide the height in that area be governed by FAA <br />Regulations. It will allow a connecting bridge between two buildings where there is some <br />common interest of ownership. Also, it will allow a 5% limitation with respect to setback <br />requirements in the MUR District. The proposed Ordinance will also amend the TDR <br />Ordinance to allow height be governed by FAA Regulations so that we have overall <br />consistency within our Code. <br /> <br />Public Speakers: Robert Kane <br /> <br />Robert Kane expressed concerns on setback impacts, and City Attorney Ottinot said our <br />Zoning Code provides the Commission with an opportunity to review all site plans. He said <br />he would meet with him, and that he did speak with his attorney Tucker Gibbs. <br /> <br />Commissioner Aelion moved and Commissioner Scholl seconded a motion to adopt the <br />ordinance. Thaler as Vice Mayor; Providing for an Effective Date. <br /> <br />Action: City Clerk Hines read the title, and Mayor Edelcup reported. <br /> <br />Public Speakers: None <br /> <br />Commissioner Aelion moved and Commissioner Scholl seconded a motion to approve the <br />resolution.
