Summary Minutes: Regular City Commission Meeting November 17, 20 II

Sunny Isles Beach, Florida

motion sensors, an extinguishing system within the cab, there is a lot of technology that they
have been working on for four years. In addition the generators will have the ability to
operate this in case of power failures. DEP has already reviewed their storm surge, wave crust
action, and they have given us approval and it is in the record that the erosion that occurs can
work its wave under their regulations through the system. One of the other nuances is that the
floor ofthis garage where the guest parking and mechanics are for the lifts are two-feet above
the sidewalk, and so we don't have any subterranean conditions here which makes it safer in
terms of storm and flood, the flood criteria is at elevation 8, and that is what that level is.

Commissioner Aelion asked about waiting in your car with the exhaust fumes, and Mr. Sieger
said if the car is on, the elevator will not operate, and if you attempt to start it, the elevator
will stop and there is a screen in the cab that tells you to turn your engine off, if you don't turn
it off in 5 seconds it goes back down and ejects you automatically. In addition Miami-Dade
County regulates elevators and they have requested that there are only three companies in the
world that certifies safety, and one of the companies is called TUV and are based in Germany,
they are going to do a third party assessment. They certify the safety of this elevator system as
to hurricane preparedness, its operation, its inherent safety, its reliability, its maintenance.
That report goes back to the County where six (6) elevator specialists will review it again.

Commissioner Aelion asked ifthe parts will be locally available, and Mr. Sieger said yes, the
machinery will have spare parts in stock in America, and there will also be spare parts at
WOHR, the company that makes the system, and Otis Elevator is a national company and all
those parts are readily available, both companies are using and applying their stock systems
that have worked for many years and combining them. Even though the idea is new, the
actual mechanics and operations which are all UL Rated and safety tested have been in
operation for many, many years, and so the real trick was combining them.

Commissioner Aelion asked the setback of the building from the coastline, according to the
design and picture that you have on your rendering, that distance from the coastline has been
satisfied according to the DEP, and Mr. Sieger said yes, and he showed him a picture and said
the descriptive analysis that they had showed yesterday to the people at Millennium, and this
is how they have basically situated their building as a good neighbor so they don't block
Millennium's lateral views. If you look at their floor plans you will see that their views are
actually tilted 45-degrees and so they don't block their views and more importantly, the
second drawing has the coastal limits of the construction line. We are actually behind the line
that we could put the building out to, and so it makes our building in terms of the scientific
calculations of the erosion, the surge, etc, it makes their building safer by backing it up.
Commissioner Aelion said in their appraisal, there is an Executive Sheet where you mention
that the building is going to be 58 stories and not 57, and Mr. Sieger said there is a slight
portion that goes into the 58th realm, the mechanical space is three stories tall on the western
side, and on the eastern side is a little roof garden penthouse for the 10,000- foot unit.

Commissioner Scholl asked Gil Dezer how much did Porsche influence the design of the
building and units, what was the tradeoff between architecture and design, and what was the
bleed over between the two, and Gil Dezer said we have an architect here that has done a
tremendous amount of buildings with a design idea, and then we have these gentlemen from
Germany that really know how to design products that sell, but the idea was really to merge
