0 <br /> ® THIRTY ONE- MAINTENANCE BY TENANT: Tenant shall at all times keep the leased <br /> ® premises (including Maintenance at exterior entrances, all glass and all glass and show window <br /> ® moldings)and al partitions,doors,fixtures,equipment and appurtenances thereof(including lighting, <br /> ® heating,and plumbing fixtures,escalators,elevators,electrical equipment and any air conditioning <br /> system)in good order,condition and repair(including reasonable periodic painting as determined by <br /> ® the Landlord)damage, by unavoidable casualty excepted, except for structural portions of the <br /> ® premises, which shall be maintained by Landlord, and Landlord is required to make repairs to the <br /> structural portions by reason of Tenant=s negligent acts or omissions to act. Landlord may add the <br /> ® cost of such repairs to the rent which shall thereafter become due. It is understood that the <br /> maintenance of all utility lines and appurtenance of all utility lines and appurtenance from the leased <br /> ® premises to the points at which such utility lines and appurtenance serving only the leased premises <br /> ® connect into main utility lines serving other portion of the Center than the leased premises is the <br /> responsibility and obligation of Tenant and that such portions of the Center than the leased premises <br /> is the responsibility and obligation of Tenant and that such utility lines serving only the leased <br /> premises rare not for the purposes hereof part of the structural portions of the Center. Tenant shall <br /> keep interior and exterior of all doors and show windows clean and neat. In the event the Tenant <br /> fails to do so,Landlord may clean said doors and show windows and charge Tenant for cost thereof. <br /> THIRTY TWO-SURRENDER OF PREMISES:At the expiration of the tenancy hereby created, <br /> Tenant shall surrender the leased premises in the same condition as the leased premises were in upon <br /> delivery of possession thereto under this lease,reasonable wear and tear and damage by unavoidable <br /> casualty excepted, and shall surrender keys for the leased premises to Landlord at the place then <br /> fixed from the payment of rent and shall inform Landlord of all combination locks,safes and vaults, <br /> if any, in the leased premises. Tenant shall remove all its trade fixtures before surrendering the <br /> premises as aforesaid and shall repair any damage to the leased premises caused thereby. Tenant=s <br /> obligation to observe or perform this covenant shall survive the expiration or other termination of the <br /> ® lease <br /> THIRTY THREE-LOSS AND DAMAGE: Landlord shall not be responsible for any damage to <br /> ® property of Tenant of other located on the leased premises nor for the loss of or damage to any <br /> ® property of Tenant or of others by theft or otherwise. Landlord shall not be liable for any injury or <br /> damage to persons or property resulting from fire,explosion,falling plaster, steam,gas,electricity, <br /> water, rain or leaks from any part of the leased premises or from the pips, appliances or plumbing <br /> works or from the roof, street or subsurface or from any other place or by dampness or by any other <br /> cause whatsoever nature. Landlord shall not be liable for any such damage caused by other tenants <br /> ® or persons in leased premises occupants of adjacent property,of the Shopping Center,or the public, <br /> or caused by operations in construction of any private,public,or quasi public work. Landlord shall <br /> ® not be liable for any latent defect in the leased premises or in the building.
