0 <br /> 0 <br /> THIRTY FOURTH: SUBORDINATION: This lease and all the rights herein are hereby <br /> ® subordinated and made subject and inferior to the Mortgage(s) if any on the property, and the <br /> Mortgage(s) if any, are superior to the lease, without exception. This agreement shall remain in <br /> effect without the necessity of the execution of any further documentation as to the mortgage(s)and <br /> any and all amendments,modifications,renewals,extensions,or consolidations thereof. The tenant <br /> agrees to execute and all documents required by the Mortgagee to implement the provisions of this <br /> lease. <br /> THIRTY FIFTH: CONTRACTORS/WORKMEN LIENS: The tenant shall pay all debts <br /> incurred to mechanics,laborers,material men,contractors,and sub-contractors who perform labor, <br /> 9 services,or provide material to the leased premises so as to avoid any liens against the property. The <br /> ® tenant shall indemnify and hold harmless the Landlord from any claim of lien filed against the leased <br /> premises as a result of tenants non-payment. Should the Landlord be brought into suit as a result of <br /> a lien caused by the tenant, the tenant shall pay all Landlords reasonable attorneys fees and court <br /> ® costs and additional rent <br /> THIRTY SIXTH: CONDEMNATION:If the whole of the leased premises shall be contemned by <br /> ® Eminent Domain or acquired in lieu of condemnation for any public or quasi-public use or purpose, <br /> ® then the term of this lease shall terminate as of the date that title vests in the condemning <br /> 9 governmental body or other authority. Alternatively, if a portion of the leased premises shall be <br /> taken or acquired in lieu of condemnation, them this lease shall automatically terminate as to that <br /> portion of the leased premises as of the date that title is transferred, and the rental rate shall be <br /> ' reduced on a pro rata basis in accordance wit the percentage of the property taken. If more than Ten <br /> (10%) percent of the leased area is acquired or any portion of the building improvements, Tenant <br /> shall have the option to terminate this lease by giving notice to Landlord within thirty(30)days after <br /> O title vests in the condemning governmental body or other authority. <br /> ® THIRTY SEVENTH: This Lease supersedes all other leases. This lease may not be recorded. <br /> ® THIRTY EIGHTH: <br /> HAZARDOUS WASTE AND INDEMNIFICATION: <br /> Tenant hereby covenants and agrees that it shall not bring or transport onto the Leased Premises,or use or store <br /> in,on,or about the Leased Premises,or in the vicinity thereof,in connection with Its use and occupancy of the <br /> ® Leased Premises,or permit any other party to do any of the foregoing,any environmentally hazardous materials, <br /> substances or waste of any nature that is classified as such by any county, municipal,state,federal or other <br /> 9 governmental authority.Tenant agrees to Indemnify Landlord and save it harmless from and against any and all <br /> claims, losses,actions,damages, liabilities end expenses,including reasonable legal tees and expenses,and <br /> ® reasonable clean-up costs suffered or incurred by Landlord,for or on account of or arising from or in connection <br /> ® with any breach of Tenant's warranties,representations or obligations under this Section,or in connection with <br /> any condition erected by Tenant as the result of any spill,discharge or release of any environmentally hazardous <br /> 9 materials,substances or waste In,on or about the Leased Premises,or in the vicinity thereof. <br /> ® ACCELERATION: <br /> 9 If tenant breaches this lease or vacates the premises prior to the expiration of the lease, the Landord may <br /> 9 accelerate the term of this lease and declare all rents for the remaining terms to be immediately due and payable. <br /> 0 <br /> • 9 <br /> vsy \ \ <br /> (ik'SeS-.qc P ko TcGcAS ;C -Vau:rAct -1' (&.o✓tR-"LAC.WI <br />
