<br />City of Sunny Isles Beach |Request for Qualifications No. 18-02-01 16 <br /> <br /> <br />2.21 BACKGROUND CHECKS <br /> <br />The successful Firm will be responsible for hiring the necessary personnel to conduct the specified <br />services and will comply with all federal, state, and local laws related to minimum wage, social <br />security, nondiscrimination, Americans with Disabilities Act (“ADA”), unemployment compensation, <br />and workers’ compensation. All staff assigned to this contract shall be required, at their sole cost <br />and expense, to pass a criminal background check prior to award of the contract. The criminal <br />background check shall consist of a Florida Department of Law Enforcement (“FDLE”) Florida Crime <br />Information Center/National Crime Information Center (“FCIC/NCIC”) criminal records check. Any <br />employee not meeting this requirement will not be permitted to work at any City facility. <br /> <br /> <br />2.22 RESTRICTIONS TO PUBLIC ACCESS TO PROJECT PLANS <br /> <br />The Contractor shall be advised that public access to project plans is now restricted, and plans are <br />no longer subject to public records requests, as per Florida Status F.S.119.07(3)(ee) which states: <br /> <br />“Building plans, blueprints, schematic drawings, and diagrams, including draft, preliminary <br />and final formats, which depict the internal layout and structural elements of a building, <br />arena, stadium, water treatment facility, or other structure owned or operated by an agency <br />as defined in s.119.011 are exempt from the provisions of subsection (1) and s. 24(a), Art. 1 of <br />the State Constitution. This exemption applies to building plans, blueprints, schematic <br />drawings, and diagrams, including draft, preliminary, and final formats, which depict the <br />internal layout and structural elements of a building, arena, stadium, water treatment facility, <br />or owned or operated by an agency before, on, or after the effective date of this act. <br />Information made exempt by this paragraph may be disclosed to another governmental entity <br />if disclosure is necessary for the receiving entity to perform its duties and responsibilities, to a <br />licensed Engineer or contractor who is performing work on or related to the building, arena, <br />stadium, water treatment facility, or other structure owned or operated by an agency; or upon <br />showing of good cause before a court of competent jurisdiction. The entities or persons <br />receiving such information shall maintain the exempt status of the information. This <br />paragraph is subject to the Open Government Sunset Review Act of 1995 in accordance with <br />s. 119.15, and shall stand repealed on October 2, 2007, unless reviewed and re-enacted by the <br />Legislature.” <br /> <br />2.23 PUBLIC RECORDS <br /> <br />IF THE CONTRACTOR HAS QUESTIONS REGARDING THE <br />APPLICATION OF CHAPTER 119, FLORIDA STATUTES, TO THE <br />SUCCESSFUL PROPOSER’S DUTY TO PROVIDE PUBLIC
