<br /> <br /> <br /> <br /> <br />VARIATIONS/EXCEPTIONS <br />The City will need assistance with the creation, acquisition, and recording of required easements, which we <br />are looking forward to doing. We do expect that some Legal Services will be required to accomplish <br />easement acquisitions. Because the professional liability related insurance coverage demands of attorneys <br />are quite different than that for engineering firms, having an attorney subcontract through an engineer will <br />present insurability concerns for the engineer, who as prime holds contractual responsibility for its sub- <br />consultants. We anticipate that our team’s services will include project management of and coordination of <br />any required legal services needed related to the team’s work <br /> <br />In order to eliminate professional liability insurance related issues for the team we respectfully request that <br />the City contract directly with the Attorney for legal services related to this project. That would allow the <br />City to avoid potential uninsurable circumstances for the Engineer as well as allow the Attorney to function <br />directly for the City, with the protections of their insurance flowing directly to the City. This would also <br />establish clearly that the Attorney’s client is the City and no other party under this arrangement giving the <br />City all the benefits of an Attorney-Client relationship. <br /> <br />We take this project very seriously and fully expect to be performing work for the City for this effort in the <br />next few months. We take the quality of our work and our indemnification of our clients <br />seriously. Therefore, we consulted our professional liability carrier to review the details of the City’s <br />indemnification and insurance requirements. If we are selected for this assignment, we would work in <br />partnership with the City to confirm that the contract language complies with the state statutes Chapter <br />725.08 and is insurable. Our goal is to protect our clients so that our indemnification is legally valid and so <br />that it provides you with the requested protection by our Professional Liability Insurance policy. <br />
