ORDINANCE NO. 2014- y 3 I <br /> AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH, <br /> FLORIDA, AMENDING CHAPTER 62 OF THE CODE OF <br /> ORDINANCES TO CLARIFY THAT PURCHASES IN EXCESS <br /> OF $25,000.00 FOR UTILITIES SHALL BE <br /> ADMINISTRATIVELY APPROVED IN THE ADOPTED FISCAL <br /> YEAR BUDGET AND ARE NOT SUBJECT TO THE <br /> REQUIREMENTS OF CHAPTER 62 UNLESS REQUIRED BY <br /> THE CITY COMMISSION; PROVIDING FOR SEVERABILITY; <br /> PROVIDING FOR INCLUSION IN THE CODE; PROVIDING <br /> FOR REPEALER OF CONFLICTING PROVISIONS; <br /> PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, the purpose of Chapter 62 of the Code of Ordinances of the City of Sunny <br /> Isles Beach (the "Procurement Code") is to provide for the fair and equitable treatment of all <br /> persons involved in purchasing by the City, to maximize the purchasing value of public funds in <br /> procurement, and to provide safeguards for maintaining a procurement system of quality and <br /> integrity; and <br /> WHEREAS, Chapter 62 applies to all contracts for the procurement of supplies, services <br /> and construction entered into by the City; and <br /> WHEREAS, Chapter 62 requires that the City Commission shall approve all purchases of <br /> or contracts for materials, supplies, equipment, public improvements or services where the total <br /> amount to be expended is more than $25,000.00; and <br /> WHEREAS, the City Commission desires to amend Chapter 62 of the City Code to <br /> clarify that purchases in excess of $25,000.00 for utilities shall be administratively approved in <br /> the adopted fiscal year budget and are not subject to the requirements of Chapter 62 unless <br /> required by the City Commission. <br /> NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br /> and confirmed as being true and correct and are hereby made a specific part by this Ordinance <br /> upon adoption hereof <br /> Section 2. Amendment. Chapter 62 of the City Code is amended to read as follows: <br /> § 62-6.
