ORDINANCE NO. 2015- 4 y <br /> AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH, <br /> FLORIDA, AMENDING CHAPTER 183 OF THE CITY CODE <br /> RELATING TO "LICENSES AND PERMITS" TO CONFIRM <br /> PERMITTING REQUIREMENTS FOR CERTAIN WORK AND <br /> ACTIVITIES WITHIN THE CITY; PROVIDING FOR <br /> REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING <br /> FOR INCLUSION IN THE CODE; PROVIDING FOR AN <br /> EFFECTIVE DATE. <br /> WHEREAS, the purpose of Chapter 183 of the City Code of the City of Sunny Isles <br /> Beach is to provide certain minimum requirements in all matters relating to the issuance, <br /> revocation, and suspension of permits; and <br /> WHEREAS, permits are required to show compliance with regulations under the Florida <br /> Building Code, the City Code, as well as to promote the health, safety and general welfare of City <br /> residents and visitors alike; and <br /> WHEREAS, the City wishes to adopt this amendatory Ordinance to confirm that permits <br /> are required to construct, enlarge, alter or repair any building, structure or part thereof; and <br /> WHEREAS, the City also wishes to confirm that permits are required to 1) use, clear, fill, <br /> excavate, move, pave, grade or otherwise alter land, water or beach sand, 2) close a lane of <br /> traffic, or 3) perform work in a public right of way or easement area. <br /> NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br /> and confirmed as being true and correct and are hereby made a specific part by this Ordinance <br /> upon adoption hereof. <br /> Section 2. Amendment. Chapter 183 of the City Code is amended to read as follows: <br /> 4 183-1.—Permits required. <br /> A. Building permit required. Any owner or authorized agent who intends to construct, <br /> enlarge, alter, repair, move, demolish or change a building, structure, or part thereof, or <br /> conduct work in the public rights of way or public easement, or use, clear, fill, excavate, <br /> move, pave, grade or otherwise alter land, water or beach sand, shall first be required to <br /> obtain the applicable building permit from the City prior to commencing any such work. <br /> B. Permit for Lane Closure.
