<br />ORDINANCE NO. 2012-.36..~ <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION <br />10 ENTITLED BUDGET PROCEDURES TO CREATE A NEW <br />SECTION ENTITLED EMERGENCY FUND BALANCE <br />RESERVE; REQUIRING BUDGET AMENDMENTS BE <br />APPROVED BY ORDINANCE; PROVIDING FOR REPEALER; <br />PROVIDING FOR SEVERABILITY; PROVIDING FOR AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, Florida law requires the City Commission to adopt a balance budget each <br />year; and <br /> <br />WHEREAS, the purpose of this ordinance is to implement sound fiscal practices with <br />regard to the administration of reserve funds in the City of Sunny Isles Beach; and <br /> <br />WHERAS, the City Commission wishes to maintain an emergency reserve fund to <br />provide funding for emergency purposes. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br />and confirmed as being true and correct and are hereby made a specific part by this Ordinance <br />upon adoption hereof. <br /> <br />Section 2. Amendment. Section 10.1 of the City of Sunny Isles Beach Code of Ordinances is <br />hereby amended to read as follows: <br /> <br />S 10-1 Amendments to Budget. <br /> <br />A. Minor amendments. Transfers between line items or department accounts within <br />departmental budget or decreases in line items or department accounts not amounting <br />to more than 20% of the total budget of each department may be made by the City <br />Manager by written statement describing the transfers and the reasons therefore. A <br />copy of such statement shall be field with The City Clerk and delivered to the Mayor <br />and each of the City Commissioners. A copy shall also be posted at a conspicuous <br />place in City Hall. The transfers shall become effective 14 days after posting unless <br />the Mayor or any member of the City Commission notifies the City Manager that <br />he/she wishes the transfer to be placed upon the Agenda of the next City Commission <br />meeting for consideration by the entire City Commission.
