ORDINANCE NO. 2012- 3<?> ~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTIONS 265-5 AND 265-46 OF THE ZONING CODE TO REVISE OFF-STREET PARKING STANDARDS; PROVIDING FOR A REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, it has been determined that the off-street parking standards should be amended to provide flexibility for off-street parking spaces; and WHEREAS, it has also been determined that the minimum parking spaces required for multifamily dwellings should be amended to require units greater than 1800 square feet to provide for two parking spaces per unit. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. as follows: Amendment to Section 265-5. Section 265-5 of the City Code is amended to read Parking Space, Tandem - A parking space within a group of two or more parking spaces arranged one behind the other. An arrangement of parking spaces such that one or more spaces must be driven across in order to access another space or spaces irrespective of how configured, that involves (a) moving at least one vehicle parked in a space in order to reach and move other vehicles out of another parking space, or (b) the parking of two or more vehicles that are parked adiacent to one another, either end to end or above the other. Section 2. Amendment to Section 265-46. Section 265-46 of the City Code is amended to read as follows: A. General. Every building, use or structure, constructed or altered after the effective date of LDRs shall be provided with off-street parking facilities in accordance with the provisions of this article for the use of occupants, employees, visitors or patrons. Such off-street parking facilities shall be maintained and continued as long as the main use is continued. (4) Tandem parking. Tandem parking shall abide by the definition under Article II of this chapter. Twenty percent of the required off-street parking spaces, other than handicapped parking, may be permitted as tandem parking. If twenty four (24) hour valet service is provided in perpetuity, one hundred percent (100%) of the required parking may be permitted as tandem.
