<br />ORDINANCE NO. 2012- 3<?> ~ <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, AMENDING <br />SECTIONS 265-5 AND 265-46 OF THE ZONING CODE TO <br />REVISE OFF-STREET PARKING STANDARDS; PROVIDING <br />FOR A REPEALER; PROVIDING FOR SEVERABILITY; <br />PROVIDING FOR INCLUSION IN THE CODE; PROVIDING <br />FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, it has been determined that the off-street parking standards should be <br />amended to provide flexibility for off-street parking spaces; and <br /> <br />WHEREAS, it has also been determined that the minimum parking spaces required for <br />multifamily dwellings should be amended to require units greater than 1800 square feet to <br />provide for two parking spaces per unit. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. <br />as follows: <br /> <br />Amendment to Section 265-5. Section 265-5 of the City Code is amended to read <br /> <br />Parking Space, Tandem - A parking space within a group of two or more parking spaces <br />arranged one behind the other. An arrangement of parking spaces such that one or more spaces <br />must be driven across in order to access another space or spaces irrespective of how configured, <br />that involves (a) moving at least one vehicle parked in a space in order to reach and move other <br />vehicles out of another parking space, or (b) the parking of two or more vehicles that are parked <br />adiacent to one another, either end to end or above the other. <br /> <br />Section 2. Amendment to Section 265-46. Section 265-46 of the City Code is amended to <br />read as follows: <br /> <br />A. General. Every building, use or structure, constructed or altered after the effective date <br />of LDRs shall be provided with off-street parking facilities in accordance with the <br />provisions of this article for the use of occupants, employees, visitors or patrons. Such <br />off-street parking facilities shall be maintained and continued as long as the main use is <br />continued. <br /> <br />(4) Tandem parking. Tandem parking shall abide by the definition under Article II of <br />this chapter. Twenty percent of the required off-street parking spaces, other than <br />handicapped parking, may be permitted as tandem parking. If twenty four (24) <br />hour valet service is provided in perpetuity, one hundred percent (100%) of the <br />required parking may be permitted as tandem.
