shall be furnished City and the Engineer / Architect with each Application for Payment. <br />Failure by the Contractor to strictly comply with the provisions of this Paragraph 7.8 shall <br />constitute a material breach of this Contract. <br />7.8.1. The Contractor, within (15) days of commencing the Work shall submit to the City <br />and the Engineer / Architect for their information, an anticipated monthly draw schedule <br />for the duration of the Work. If during the course of performing the Work the Contractor <br />anticipates a substantial change in the draw schedule, the Contractor shall notify the City <br />and the Engineer/ Architect within three (3) days of anticipating such change. For purposes <br />of this paragraph, a substantial change shall be any increase or decrease equaling or <br />exceeding ten percent (10%) of any anticipated monthly draw. <br />7.9. The Contractor shall continuously maintain at the site, in an orderly fashion <br />and format acceptable to the City, for the benefit of the City and the Engineer / Architect <br />one record copy of this Contract and all Contract Documents marked to record on a current <br />basis changes, selections and modifications made during construction. Additionally, the <br />Contractor shall maintain at the site for the City and Engineer/ Architect the approved Shop <br />Drawings, Product Data, Samples and other similar required submittals. Upon final <br />completion of the Work, all of these record documents shall be delivered to the City. <br />7.9.1. No less than weekly, the Contractor shall conduct a Project meeting which <br />shall include the Contractor's administrative, managerial and supervisory personnel and <br />representatives of each subcontractor working on the Project site. The meeting shall <br />address, but shall not be limited to, the current status of the Work, including the current <br />Project schedule and the existence of any defective or deficient work as well as the <br />appropriate action required to correct or replace such work. The City and the Engineer / <br />Architect shall have the right, but not the duty, to attend such weekly meetings. The <br />Contractor shall maintain detailed minutes of each such weekly meetings and shall <br />distribute typewritten copies of such minutes to the City and the Engineer / Architect no <br />later than the close of the next workday following completion of such meeting. The <br />Contractor shall further require its General Superintendent to maintain a daily job diary <br />which shall include for each work day the daily weather conditions, the identity of each <br />subcontractor working on the site, the manpower of each subcontractor working on the <br />site, the identity of all visitors to the Project site, documentary progress photographs, and <br />any and all other information reflecting any delays, hindrances, interferences, or other <br />problems encountered or incurred on the Project site. Each week the Contractor shall <br />furnish to the City and the Engineer / Architect on a weekly basis full and complete copies <br />of said daily job diary. <br />7.10 Shop Drawings, Product Data and Samples <br />7.10.1. Shop Drawings, Product Data, Samples and other submittals from the <br />Contractor do not constitute Contract Documents. Their purpose is merely to demonstrate <br />Page 18 of 43 <br />286 <br />
