City Clerk <br /> Brown-Morilla read the applicant's name, hearing number, and location. The City Clerk <br /> administered the oath to the witnesses for the evening's Zoning hearing, and City Attorney <br /> Dannheisser read a disclaimer for the Zoning hearing. <br /> Public Speakers: Stanley Price,Esq.; Kobi Karp; Public Works Superintendent Bob Pushkin; <br /> Arnold Shevlin; Zoning and Code Administrator Jorge Vera; Gerry Goodman; Cecile <br /> Sippen; Phillip Chemoff; Natasha Reinhard [submitted copies of petitions into the record]; <br /> Jay Rei <br /> Stanley Price, Esq. said the applicant was asking to modify previously approved plans, <br /> seeking approval for the original concept of two, taller buildings for the site, instead of three <br /> buildings. He proferred a unity of title to all of the tracks of land that could not be modified <br /> without the prior consent of the City Commission. Mr. Price submitted into the official <br /> record petitions from Winston Towers residents. He also noted that the previously approved <br /> plan required the applicant to provide land for a park, and to maintain it. The applicant was <br /> now asking to donate an area of land to the City for a park(with the applicant to`physically <br /> improve the park in terms of fill and otherwise") provid the City with the necessary <br /> easements to access the park. The applicant did not wish to be responsible for future <br /> maintenance of the park. <br /> Kobi Karp displayed the architectural layout of the new proposal, including three shadow <br /> studies which were submitted into the record. Mayor Samson asked the distance of the <br /> buildings from the Intracoastal, and Mr. Karp said they were approximately 50 feet. <br /> Commissioner Iglesias suggested traffic signange improvements on North Bay Road. Mayor <br /> Samson said he wasn't willing to have the City become responsible for maintenance of the <br /> park. <br /> Arnold Shevlin said there would be a 4 foot easement. Mr. Price clarified that the walkway <br /> on the west side of the property along the Intracoastal would not be open to the public. He <br /> suggested that if the developer would dedicate the park to the City with a boardwalk [at a <br /> future City Commission meeting],the City agree to go with the developer to ask the County <br /> to grant a credit for the parks impact fee equal to the value of the improvements being <br /> donated.
