d. Cost data comparing the proposed substitution with the Product <br /> specified <br /> e. Any required license fees or royalties <br /> f. Availability of maintenance service, and source of replacement <br /> materials <br /> 3. The Engineer shall be the judge of the acceptability of the proposed <br /> substitution. <br /> 4. No substitutions will be considered by the Engineer after 30 days from the <br /> Contract Date. <br /> D. Contractor's Representation: <br /> 1. A request for a substitution constitutes a representation that Contractor: <br /> a. Has investigated the proposed Product and determined that it is <br /> equal to or superior in all respects to that specified <br /> b. Will provide the same warranties or bonds for the substitution as for <br /> the Product specified <br /> c. Will coordinate the installation of an accepted substitution into the <br /> Work, and make such other changes as may be required to make <br /> the Work complete in all respects <br /> d. Waives all claims for additional costs, under his responsibility, which <br /> may subsequently become apparent. <br /> E. The Engineer will review requests for substitutions with reasonable promptness, and <br /> notify Contractor, in writhing, of the decision to accept or reject the requested <br /> substitution. <br /> 1.08 SPECIAL TOOLS <br /> A. Manufacturers of equipment and machinery shall furnish any special tools (including <br /> grease guns or other lubricating devices) required for normal adjustment, operations <br /> and maintenance, together with instructions for their use. The Contractor shall <br /> preserve and deliver to the Owner these tools and instructions in good order no later <br /> than upon completion of the Contract. <br /> 1.09 STORAGE AND HANDLING OF EQUIPMENT ON SITE <br /> A. Because of the long period allowed for construction, special attention shall be <br /> given to the storage and handling of equipment on site. As a minimum, the <br /> procedure outlined below shall be followed: <br /> 1. Equipment shall not be shipped until approved by the Engineer. The intent <br /> of this requirement is to reduce on-site storage time prior to installation <br /> and/or operation. Under no circumstances shall equipment be delivered to <br /> the site more than one month prior to installation without written <br /> authorization from the Engineer unless it is to be stored as specified in <br /> Paragraph 1.06 herein upon arrival. Operation and maintenance data as <br /> described in Paragraph 1.08 of Section 01730 shall be submitted to the <br /> Engineer for review prior to shipment of equipment. <br /> 2. All equipment having moving parts such as gears, electric motors, etc. <br /> and/or instruments shall be stored in a temperature and humidity controlled <br /> building approved by the Engineer, until such time as the equipment is to be <br /> 08/12 01600-5 11-4179 <br />
