related to this Agreement shall comply with the Federal Education Rights and Privacy Act <br /> (FERPA), 20 U.S.C. §1232g, and the Florida Education Code and School Board Policies and <br /> Procedures. The parties hereto hereby acknowledge and agree that student data will not be <br /> provided to the City. <br /> 1. The written reports shall include the following information, if applicable: <br /> a. Number of letters mailed to students enrolled <br /> b. Number of letters returned after mailing <br /> c. Number of students residing outside the boundaries <br /> d. Number of transfer students <br /> e. Number of students transferred to their home school <br /> f. Number of students granted an exemption <br /> (e) The parties hereto hereby acknowledge and agree that the children of active <br /> military personnel assigned to the Department of the Army, United States Southern <br /> Command who attend Miami-Dade County public school shall have equal priority, for <br /> enrollment purposes, with the students that reside in the attendance boundaries of the school <br /> in Sunny Isles Beach. <br /> (f) For the purpose of this Agreement, the term residence and/or address mean <br /> the home location where the student and a parent (if applicable) are primarily living. Parents <br /> is defined as either or both biological or adoptive parent(s) of the student, the student's legal <br /> guardian, a person in a parental relationship to the student, or a person exercising <br /> supervisory authority over the student in place of the parent, pursuant to Section 1000.21(5), <br /> Florida Statutes. <br /> (g) For the purpose of this Agreement, obtaining a temporary address within the <br /> boundary of the school shall not be considered a valid residency, unless the student <br /> demonstrates that the address is his or her primary address. Primary residence and/or <br /> address means the home in which the student and a parent (if applicable) lives most of the <br /> time. <br /> (h) Address Verification letters shall be mailed to students by certified mail at the <br /> expense of the City. <br /> (i) <br /> Section 2. Funding <br /> (a) The City agrees to provide $80,000.00 a year for the 2016-2017 school year <br /> and, the City will provide full funding for the Plan pursuant to the District's costs as <br /> determined by the School Board and agreed to by the City Commission, including, without <br /> limitation, compensation plus fringe benefits, not to exceed $80,000.00 as set forth in <br /> subsection (b), for the duration of this Agreement and for the duration of the Plan, defined <br /> herein as "Adequate Funding." <br /> (b) The parties acknowledge that the average salary of the part-time assistant is <br /> approximately $12.00 per hour, with an anticipated workload of 25 hours per week. Payment <br /> will be made to the School Board within 30 days of the City receiving an invoice from the <br /> 2 <br />
