I I <br /> • <br /> Circumstances that could be indicators of a substance abuse problem and considered reasonable <br /> suspicion are: <br /> I. Observable phenomena while at work,such as direct observation of chug use or of the physical <br /> symptoms or manifestations of being under the influence of a drug. <br /> 2. Abnormal conduct or erratic behavior while at work or a significant deterioration in work <br /> performance. <br /> 3. A report of drug use,provided by a reliable and credible source. <br /> 4. Evidence that an individual has tampered with a drug test during his or her employment with the <br /> current employer. <br /> 5. Information that an employee has caused,contributed to,or been involved in an accident while at <br /> work. <br /> 6. Evidence that an employee has used,possessed,sold,solicited,or transferred drugs while working <br /> or while on the employer's premises or while operating the employee's vehicle,machinery,or <br /> equipment. <br /> The Company also reserves the right to ask any employee to submit to drug testing under the <br /> following conditions: <br /> B. Post-Accident <br /> When an employee is involved in an accident that causes injury to himself/herself or to any other <br /> person or damage to any property. If, because of the accident, an employee is unable to submit to <br /> drug testing immediately, the employee will authorize the release of any medical reports or <br /> documentation regarding the presence of illegal drugs or alcohol in the employee's body at the time <br /> of the accident to the MRO. Refusal to agree to this release will result in termination of the <br /> employee;or <br /> C. Pursuant to any required employee fitness-for-duty examination <br /> D. Follow-up Drug Testing <br /> If the employee in the course of employment enters an employee assistance program for drug-related <br /> problems or a drug rehabilitation program, the Company will require the employee to submit to a <br /> drug test as a follow-up to such program, unless the employee voluntarily entered the program. In <br /> such case, the Company has the option not to require follow-up testing. If follow-up testing is <br /> required, it will be conducted at least once a year for a two-year period after the completion of the <br /> program. Advance notice of the follow-up testing date will not be given to the employee who is to <br /> be tested. <br /> [4] <br /> Lukes' Landscaping, Inc. <br />
