Stunmare Minutes: Regular Ciro Commission Meeting March 21. 2013 City of Sunny Isles Beach. Florida <br />the City Commission for hiring and terminating the Police Chief. At this time. with the <br />exception of the City Attorney's Office, the City Manager has the authority to hire or fire any <br />of the employees of the City. The second change was basically requiring candidates for the <br />office of the Mayor and Commission to provide more specific proof at the time of filing <br />candidacy with the City Clerk of the following: current voters registration card and proof of <br />residency within the City. In order to run for the office of Mayor or City Commissioner you <br />must reside in the City for at least one year. Additionally if you are running for a residential <br />seat. you must reside in that residential district for one year. Another change that the CRC is <br />recommending is to extend time limits for the CRC to file the report with the Commission. <br />Currently the CRC, from date of appointment. has 90 days to complete this work and submit <br />their recommendations to the Commission. Some members of the CRC felt they needed <br />additional time due to business or family issues and they wanted to extend their time to 120 <br />days. Nevertheless they may finish their report prior to the 120 days. Another proposed <br />recommendation is the removal of the mandatory requirement that this City use Miami -Dade <br />Fire Rescue service. We are probably the only City since Miami -Dade County has permitted <br />cities to incorporate since 1995 to have that provision in its Charter. He clarified that it <br />doesn't mean we are moving away from Miami -Dade Fire Rescue, it is just removing this <br />mandatory requirement that basically makes us the same as other new cities in Miami -Dade <br />County. One last amendment that the CRC has proposed is basically to recommend that the <br />CRC selects its own chairperson currently based on his interpretation that appointment was <br />made by the Mayor. <br />Mayor Edelcup suggested we now hear Item 713 regarding the Charter Amendments. <br />Commissioner Scholl moved and Commissioner Levin seconded a motion to take item 7B <br />out of order and to hear now. The motion was approved by a voice vote of 5 -0 in favor. <br />6. ZONING: ZONING HEARINGS ARE QUASI - JUDICIAL PUBLIC HEARINGS. <br />None <br />7. ORDINANCES FOR FIRST READING <br />7A. An Ordinance of the City Commission of the City of Sunny Isles Beach. Florida_ Amending <br />Chapter 108 of the City Code Relating to Beaches to Prohibit the Removal of Beach Sand <br />from Private Property Without a City Permit and Except Pursuant to Guidelines <br />Established by the State of Florida; Providing for Severability; Providing for Repeal of <br />Conflicting Provisions; Providing for Inclusion in the Code; and Providing for an Effective <br />Date. <br />Action: [City Clerk's Note: This item was heard after Item 7B.] City Clerk Hines read the <br />title. and Mayor Edelcup said with all the construction going on in this City. he didn't want <br />to see any of the sand on our beaches or anywhere in the City disappearing. There was <br />nothing in our City Code to prevent any of the developers from when they are excavating to <br />build new projects, to turning around and selling that sand. Because of that circumstance he <br />had asked City Attorney Ottinot to prepare this Ordinance that prohibits developers from <br />selling sand and basically saving that any sand in our City stays in our City. and it can't be <br />sold, delivered, or given away to other municipalities. <br />
